If You Purchased Gerber® Good Start® Infant Formula in Missouri between March 14, 2011, Through the Present, A Class-Action Lawsuit Settlement May Affect Your Legal Rights

  • A proposed Missouri settlement has been reached in a class action lawsuit that claims Gerber Products Company (“Gerber” or “Defendant”) misleadingly claimed that use of Gerber® Good Start® infant formula (the “Product”) could reduce the risk of developing allergies.
  • Gerber denies these claims.
  • There are no allegations that the Product was defective or caused any bodily harm.
  • The Court has allowed a lawsuit in Missouri to proceed as a class action, which means that the named plaintiff will be representing a “Class,” or group of people, that could include you. You are a member of the Class if you purchased Gerber® Good Start® infant formula in the State of Missouri between March 14, 2011, through the present primarily for personal, family or household purposes.

LEGAL RIGHTS AND OPTIONS FOR CLASS MEMBERS

Do Nothing

Participate in the Settlement and release of claims against Gerber in exchange for Gerber’s binding agreement to change certain practices in labeling and marketing the Product.

Exclude Yourself

If you wish to opt out of the Settlement, you must postmark your letter requesting exclusion from the Class, as described in the Long Form Notice or FAQ 10 by January 26, 2024.

Comment/Object

Write to the Court by January 26, 2024, explaining why you like or do not like the Settlement FAQ 14. You must remain in the Class to comment on or object to the Settlement. If you file an objection, you or your attorney may also speak in Court at the hearing that will be held to determine the fairness of the Settlement (“Fairness Hearing”).
